Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the ICMEG website, platforms, events, initiatives, communications, and associated services operated by the Indian Council of Media, Entertainment & Gaming (“ICMEG”, “we”, “our”, or “us”).

By accessing, browsing, registering on, or using this Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must discontinue use of the Website immediately.

1. Background of the Company

The Indian Council of Media, Entertainment & Gaming (ICMEG) is a Section 8 not-for-profit institutional body established to support, promote, integrate, and strengthen India’s media, entertainment, gaming, AVGC-XR, film, music, digital content, and creative technology ecosystem.

The Website serves as ICMEG’s official digital platform for conferences, summits, policy engagement, partnerships, networking, ecosystem outreach, stakeholder participation, industry collaboration, and institutional initiatives. While ICMEG may partner with government ministries and public bodies (including MeitY, DPIIT, Skill India, NFDC, CBFC, Invest India, NSDC, and FICCI), ICMEG is an independent non-governmental organisation. Listing of government partners does not imply government endorsement of any specific service, product, or individual member.

2. Membership Terms

2.1. Eligibility and Application: Membership in ICMEG is open to individuals and organisations engaged in or associated with the creative economy sectors including Film, Music, Media, Animation, VFX, Gaming, Esports, Comics & IP, Creative Tech, AI for Creatives, and XR (AR/VR/MR). ICMEG reserves the sole discretion to accept, reject, or defer any membership application without obligation to provide reasons.

2.2. Membership Categories and Fees: Membership categories, eligibility criteria, and associated fees are as published on the Website at www.icmeg.org/membership and are subject to change. Fees once paid are non-refundable except as expressly provided in these Terms or applicable law. ICMEG will provide at least 30 days' notice of fee revisions to existing Members.

2.3. Member Obligations: As a Member, you agree to:

  • Provide accurate, current, and complete information at the time of registration and maintain its accuracy.
  • Not misrepresent your membership status, credentials, or affiliation with ICMEG.
  • Comply with ICMEG's Code of Conduct, Ethical Standards, and any applicable policies published by ICMEG.
  • Not use your membership to engage in any illegal, fraudulent, defamatory, or harmful activity.
  • Promptly notify ICMEG of any material change in your organisational details, contact information, or legal status.

2.4. Membership Duration and Renewal: Membership shall be valid for the duration specified at the time of registration (typically one calendar year unless otherwise specified). Renewal is not automatic; Members must actively renew before expiry. ICMEG is not liable for any loss arising from lapsed membership due to failure to renew.

2.5. Suspension and Termination of Membership: ICMEG may suspend or terminate membership with immediate effect, without refund of fees, if:

  • A Member provides false or misleading information.
  • A Member breaches these Terms, ICMEG's Code of Conduct, or any applicable law.
  • A Member engages in conduct that is detrimental to ICMEG's reputation or interests.
  • A Member is subject to insolvency proceedings, criminal charges, or regulatory action relevant to the creative economy sector.

Terminated Members may be barred from re-joining at ICMEG's discretion. Members who wish to dispute a termination may submit a written appeal to governance@icmeg.org.com within 14 days of notification.

3. Use of the Website

3.1. Permitted Use: You may access and use the Website solely for lawful purposes and in accordance with these Terms and our Privacy Policy. Permitted uses include browsing publicly available content, submitting membership enquiries, registering for events, and accessing resources to which you are entitled.

3.2. Prohibited Conduct: You must not:

  • Use the Website in any manner that violates any applicable Indian or international law or regulation.
  • Transmit unsolicited commercial communications (spam) or engage in any form of harassment.
  • Introduce or distribute malware, viruses, spyware, or any other malicious code.
  • Attempt to gain unauthorised access to any part of the Website, ICMEG's systems, or other users' data.
  • Scrape, crawl, or systematically extract data from the Website without prior written consent.
  • Impersonate ICMEG, any ICMEG officer, partner, or another user.
  • Circurvent or interfere with security features of the Website.
  • Use the Website to spread disinformation, hate speech, or content that is obscene, defamatory, or discriminatory.
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Website for commercial purposes without express written authorisation.

4. Intellectual Property

4.1. All intellectual property rights in and to the Website and its contents, including but not limited to text, articles, publications, reports, whitepapers, conference materials, databases, designs, graphics, logos, trade names, trademarks, service marks, branding elements, photographs, audio-visual content, videos, software, source code, user interface elements, event materials, promotional content, compilations, and other proprietary materials made available through the Website (“Website Content”), are owned by, licensed to, or lawfully controlled by ICMEG and are protected under applicable intellectual property, copyright, trademark, and related laws.

4.2. ICMEG, the ICMEG name, logos, institutional identifiers, event names, summit titles, conference branding, initiative names, and associated visual identities constitute proprietary intellectual property and shall not be used, reproduced, imitated, adopted, registered, or exploited without our prior written authorisation.

4.3. Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Website solely for personal, informational, professional, and non-commercial purposes connected with legitimate engagement with ICMEG.

4.4. Except as expressly permitted in writing by ICMEG, you shall not:

  • reproduce, copy, republish, modify, adapt, translate, distribute, transmit, display, perform, publish, license, sell, commercially exploit, or create derivative works from any Website Content;
  • use any data mining, scraping, crawling, harvesting, automated extraction tools, bots, or similar technologies to extract Website Content or data;
  • remove, alter, obscure, or tamper with copyright notices, proprietary legends, watermarks, attribution notices, or intellectual property markings;
  • use ICMEG’s intellectual property in any manner that suggests sponsorship, endorsement, affiliation, partnership, or association without prior written consent;
  • reproduce or circulate conference recordings, publications, event materials, speaker sessions, reports, or institutional documents beyond permitted personal or internal reference use.

4.5. Any unauthorised use of the Website Content or ICMEG’s intellectual property constitutes a violation of applicable intellectual property laws and these Terms, and may result in legal action, injunctive relief, damages, account suspension, or other remedies available under law.

4.6. Where users submit content, materials, proposals, photographs, testimonials, recordings, presentations, creative works, or other submissions to ICMEG through the Website or in connection with ICMEG events and initiatives, the user represents and warrants that they possess all necessary rights, licences, permissions, and authorisations in relation to such materials.

4.7. By submitting such materials, you grant ICMEG a non-exclusive, worldwide, royalty-free, sublicensable right to use, reproduce, display, publish, distribute, archive, communicate, promote, and utilise such submissions solely for institutional, operational, event-related, promotional, archival, reporting, educational, publicity, and ecosystem engagement purposes connected with ICMEG and its initiatives, unless otherwise agreed in writing.

4.8. If you believe that any content available on the Website infringes your intellectual property rights, you may submit a written notice to governance@icmeg.org.com with complete details of the alleged infringement, supporting ownership documents, and the specific material sought to be reviewed or removed.

5. Disclaimers and Limitation of Liability

5.1. Website Availability: The Website is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. ICMEG does not guarantee that the Website will be continuously available, error-free, or free from technical interruptions. ICMEG reserves the right to suspend, modify, or discontinue the Website or any Service at any time without notice.

5.2. Accuracy of Information: While ICMEG endeavours to ensure the accuracy of information published on the Website, it makes no representations or warranties regarding the completeness, accuracy, timeliness, or suitability of any Content. Any reliance you place on information from the Website is at your own risk.

5.3. No Professional Advice: Nothing on the Website constitutes legal, financial, regulatory, investment, or professional advice. ICMEG's policy papers, reports, and publications are for general informational and advocacy purposes only. You should seek qualified independent professional advice before making decisions based on ICMEG's content.

5.4. Limitation of Liability: To the fullest extent permitted by applicable Indian law, ICMEG, its directors, officers, employees, partners, and advisers shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages arising from your inability to access or use the Website or Services.
  • Any third-party content or conduct encountered through the Website.

6. Indemnification

You agree to indemnify, defend, and hold harmless ICMEG, its officers, directors, employees, representatives, affiliates, partners, and agents from and against any claims, liabilities, damages, losses, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to: your use or misuse of the Website or ICMEG services; your breach of these Terms, the Privacy Policy, or applicable law; any false, inaccurate, misleading, or unlawful information or material submitted by you; your infringement of any intellectual property, privacy, publicity, or other third-party rights; or any act, omission, negligence, misconduct, or unauthorised activity committed by you in connection with the Website or ICMEG activities. This indemnity obligation shall survive termination or discontinuation of your use of the Website or engagement with ICMEG.

7. Force Majeure

ICMEG shall not be held liable for any failure or delay in performance of its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, civil unrest, government actions, power failures, cyberattacks, industrial action, or changes in law. ICMEG will make reasonable efforts to resume normal operations as soon as practicable.

8. Anti-Corruption and Ethical Conduct

ICMEG is committed to ethical conduct and zero tolerance for corruption, bribery, or fraud. By engaging with ICMEG, you agree to comply with the Prevention of Corruption Act, 1988, the Foreign Contribution (Regulation) Act, 2010 (FCRA), and any other applicable anti-bribery and anti-corruption laws. You must not offer, give, receive, or solicit anything of value to influence the actions of any ICMEG official or any government authority in connection with ICMEG's activities.

9. Social Media and External Communications

When mentioning ICMEG on social media or other public platforms, you must not make false or misleading statements about your relationship with ICMEG, the nature of your membership, or ICMEG's positions and endorsements. You must not represent yourself as an authorised spokesperson of ICMEG unless expressly authorised in writing. ICMEG reserves the right to request the removal of any content that misrepresents ICMEG.

10. Newsletter and Communications

By subscribing to ICMEG's newsletter or providing your email address, you consent to receive electronic communications from ICMEG. You may withdraw this consent at any time by using the unsubscribe link in any communication or by contactinggovernance@icmeg.org.com. ICMEG shall process such requests within 10 business days. Transactional communications related to your membership or event registrations may continue even after unsubscribing from marketing communications.

11. Accessibility

ICMEG is committed to making the Website accessible to all users, including persons with disabilities, in alignment with applicable provisions of the Rights of Persons with Disabilities Act, 2016. If you experience accessibility barriers on the Website, please contact us at governance@icmeg.org.com and we will endeavour to provide reasonable assistance.

12. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or arbitral tribunal of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms, without affecting the validity and enforceability of the remaining provisions. These Terms, together with ICMEG's Privacy Policy and any event-specific terms, constitute the entire agreement between you and ICMEG with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.

13. Waiver

No failure or delay by ICMEG in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any breach shall not constitute a waiver of any subsequent breach of the same or any other provision.
